Terms of Use

1. Agreement

These Terms of Use ("Terms") are a legal agreement between you and KiriVPN ("KiriVPN", "we", "us", or "our"). By creating an account, accessing the website, using the apps, connecting to a VPN server, spawning a private or on-demand server, or purchasing a subscription, you agree to these Terms.

If you do not agree to these Terms, do not create an account or use KiriVPN.

2. Eligibility and Account Responsibility

You must be at least 18 years old, or the age of legal majority where you live, to use KiriVPN. You are responsible for your account, your devices, your credentials, and all activity that occurs through your account or VPN configuration files. Keep your password and VPN keys secure. Tell us promptly if you believe your account has been compromised.

3. The Service

KiriVPN provides access to WireGuard-based VPN servers, account tools, bandwidth and subscription controls, and optional private or on-demand server provisioning through cloud or hosting providers. The service may change over time, and server locations, performance, providers, features, protocols, and apps may be added, changed, suspended, or removed.

4. Acceptable Use

You may use KiriVPN only for lawful purposes. You must not use KiriVPN, or allow anyone else to use your account, to:

  • violate any law, regulation, court order, contract, or third-party right;
  • send spam, phishing, malware, bot traffic, credential stuffing, scraping abuse, denial-of-service traffic, or other harmful or deceptive activity;
  • attack, scan, probe, disrupt, overload, or gain unauthorized access to any system, network, service, account, or data;
  • infringe copyright, trademark, privacy, publicity, or other intellectual property or personal rights;
  • harass, threaten, exploit, abuse, or endanger any person;
  • traffic, distribute, request, or access illegal sexual content, child sexual abuse material, or content involving exploitation of minors;
  • evade bans, sanctions, fraud controls, geographic rules, or platform terms in a way that is unlawful or abusive;
  • resell, sublicense, share, or commercially exploit KiriVPN without our written permission;
  • interfere with KiriVPN, its users, its cloud providers, or its payment providers.

You are solely responsible for how you use the internet while connected through KiriVPN. A VPN does not make illegal conduct legal.

5. Abuse, Enforcement, and Cooperation

We may investigate suspected abuse, security incidents, payment problems, excessive resource use, legal complaints, provider notices, or violations of these Terms. To protect KiriVPN, other users, networks, and providers, we may block traffic, rate-limit, suspend, terminate, remove servers, revoke VPN configurations, or refuse service at any time when we reasonably believe action is necessary.

We may respond to valid legal requests, court orders, subpoenas, law enforcement requests, provider abuse reports, chargeback investigations, and payment processor requirements. We may preserve and disclose account, billing, security, and operational information when required by law or when we reasonably believe disclosure is necessary to protect rights, safety, security, or the integrity of the service.

6. Privacy and Operational Data

KiriVPN is designed not to store the contents of your internet traffic, DNS queries, or browsing history. However, operating the service requires some data, such as account information, authentication data, payment status, subscription records, bandwidth totals, server health information, device or client identifiers, abuse and security logs, support communications, and technical information needed to run, secure, troubleshoot, bill, and improve the service.

Cloud providers, hosting providers, app stores, payment processors, operating systems, and third-party services may process data under their own terms and policies. We do not control those third-party systems.

7. Subscriptions, Payments, and Cancellation

Paid features may require a subscription or one-time pass. Prices, features, limits, billing periods, renewal terms, and cancellation options are shown in the app or checkout flow before purchase. You authorize us and our payment providers to charge the payment method you provide for selected paid services, including renewals when you choose an auto-renewing plan.

You may switch to the Free plan or cancel renewal through the account interface where available. Cancellation stops future renewal charges but does not automatically refund past charges or remove paid access already granted for the current billing period. Refunds, credits, and exceptions are handled at our discretion unless applicable law requires otherwise.

8. Availability, Servers, and Third-Party Providers

KiriVPN depends on cloud providers, hosting providers, networks, DNS, payment processors, app platforms, and other third parties. We do not guarantee uninterrupted availability, specific speeds, specific IP addresses, access to any specific website or service, availability of any country or region, or that a destination service will accept VPN traffic.

Private and on-demand servers may fail to provision, become unreachable, be rate-limited, be blocked by third parties, or be destroyed for security, abuse, billing, technical, or provider reasons. We are not responsible for losses caused by outages, blocked traffic, provider actions, maintenance, or internet routing problems.

9. Security

We use reasonable technical and organizational measures to protect the service, but no system is perfectly secure. You are responsible for securing your devices, passwords, email account, operating system, apps, browser, and VPN configuration files. You must not attempt to reverse engineer, bypass, disable, or interfere with KiriVPN security controls.

10. Intellectual Property

KiriVPN, including its software, website, designs, text, logos, trademarks, and service infrastructure, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use KiriVPN for your personal lawful use.

11. Suspension and Termination

You may stop using KiriVPN at any time. We may suspend or terminate your account, access, subscriptions, private servers, or VPN configurations if you violate these Terms, create risk for KiriVPN or others, fail to pay, cause abuse reports, trigger provider restrictions, or if we discontinue the service. Termination does not limit our rights or remedies for prior violations.

12. Disclaimers

To the maximum extent permitted by law, KiriVPN is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and uninterrupted or error-free operation.

We do not promise that KiriVPN will make you anonymous, prevent all tracking, bypass all censorship or geo-blocking, protect you from every threat, or make unlawful activity undetectable.

13. Limitation of Liability

To the maximum extent permitted by law, KiriVPN and its owners, operators, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, security incidents, provider actions, blocked access, legal claims arising from your use, or loss of business, even if we were advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims relating to KiriVPN will not exceed the greater of the amount you paid to KiriVPN in the three months before the event giving rise to the claim or USD $50.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless KiriVPN and its owners, operators, employees, contractors, suppliers, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your use of KiriVPN, your account activity, your violation of these Terms, your violation of law, your infringement of rights, or abuse reports connected to your traffic or servers.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as posting the updated Terms, updating the effective date, or requiring renewed acceptance. Continued use of KiriVPN after updated Terms become effective means you accept the updated Terms.

16. Governing Law and Consumer Rights

These Terms are governed by the laws applicable where KiriVPN is operated, without regard to conflict-of-law rules, except where mandatory consumer protection laws give you rights that cannot be waived. Nothing in these Terms limits non-waivable rights, remedies, warranties, or protections that apply under consumer, privacy, payment, or other mandatory laws.

17. Severability

If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the rest of the Terms will remain in effect.
